Terms of Use

1. Acceptance

Using the app means you have read and accepted these Terms and our Privacy Policy, which explains what data the app and our server handle. If you use Email Tracker for work, you confirm that you may accept these Terms for your organization.

2. Who Can Use the App

You must be at least 16 years old, or the minimum age required where you live, to use Email Tracker. The app is not intended for children.

3. What Email Tracker Does

Email Tracker tells you when an email you sent through the app is opened. You type a subject in the app, Apple's Mail compose sheet opens with an invisible tracking image already in the message, and you write and send the email from your own account. When the recipient's mail app loads images, you get a push notification, and the app shows the open count and a history with date and time, an approximate location, and the mail client or device when they are available.

The app needs Apple Mail installed with at least one account signed in, because the compose sheet belongs to Apple. There is no account and no sign-in. The app never reads or accesses your mailbox. Only emails composed through the app are tracked, so replies and messages written elsewhere are not.

4. No Guarantee That Opens Are Detected

Tracking depends on the recipient's mail app loading images, so opens can be missed. We do not promise that every open is detected, or that what you see is complete or exact. In particular:

• Mail apps that block remote images show no open until images are loaded.
• Apple Mail Privacy Protection pre-loads images through Apple's servers and hides the real open. The app deliberately ignores that automatic pre-fetch so it never reports a false open, which means opens by those recipients usually cannot be detected. No pixel based tracker can detect them.
• Some providers load images through a proxy. Gmail is an example: the open and its time are detected, but the location is hidden.
• Location comes from an IP address and is approximate. VPNs, proxies, and company networks change it, and opens from data center addresses show no location at all.
• To avoid false positives, the app ignores opens from your own device and network, ignores anything in the first 60 seconds after a tracked email is created, and counts repeated opens from the same reader within 5 minutes as one.
• An open means images were loaded. It does not prove that the message was read, or by whom, and a forwarded copy can register as an open.

5. Your Responsibility When You Track Emails

You choose who receives a tracked email and why. The law that applies to you may require you to tell recipients that you track opens, or to get their consent first. In the European Union and the United Kingdom, for example, GDPR and ePrivacy rules can apply to tracking pixels in email. Following the rules that apply to you is your responsibility, and we cannot advise you on what your situation requires.

You are also responsible for how you use the information the app shows you, including the approximate location and device details of the people you email.

6. Acceptable Use

You agree not to use Email Tracker to:

• follow, monitor, harass, threaten, or intimidate anyone, including an ex-partner, a family member, or an employee
• carry out surveillance that the law where you are does not allow
• send spam or bulk unsolicited email
• break any law, or the terms of your own email provider
• mislead recipients about who you are or where the email comes from

You also agree not to:

• copy, modify, or redistribute the app or any part of it
• reverse engineer or decompile the app, except where the law gives you that right
• use our tracking service outside the app, interfere with it, or try to get around its limits or security

7. Subscriptions and Payment

The app is free to download, and some features require a subscription. All purchases are made through Apple with your Apple ID. We never see or store your payment details, and prices can differ by country and currency.

• Payment is charged to your Apple ID when you confirm the purchase.
• Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period.
• You can manage or cancel a subscription on your iPhone in Settings > your Apple ID > Subscriptions.
• If a free trial is offered, it turns into a paid subscription unless you cancel before it ends, and any unused part of a trial is forfeited when you buy a subscription.
• Canceling stops future renewals. Your access continues until the end of the period you already paid for.

8. Refunds

Refunds for App Store purchases are handled by Apple, not by us. Request one at reportaproblem.apple.com. If something is wrong with the app, write to us as well and we will try to help.

9. Privacy

Our Privacy Policy explains what we store for each tracked email, what an open event records about your recipient, which services we use, and how to ask for deletion. It is part of these Terms.

10. Intellectual Property

The app, its design, text, graphics, and name belong to Maryna Plotnikova or are licensed to her. You get a personal, limited, non-transferable right to use the app on devices you own or control. Nothing else is granted. The subject lines you type and the open history you collect remain yours.

11. Disclaimer

Email Tracker is provided as it is, without warranties of any kind. We do not promise that the app will always be available, that it will work without errors, that notifications will always arrive, or that tracking results will be complete or accurate. Read section 4 before you rely on anything the app reports.

12. Limitation of Liability

To the extent the law allows, we are not liable for indirect or consequential losses, for lost profits or opportunities, or for decisions you make based on what the app reports, including a missed open or a location that turns out to be wrong. Our total liability is limited to the amount you paid for Email Tracker in the twelve months before the claim. Nothing here limits liability that cannot be limited by law, and this does not affect consumer rights you have where you live.

13. Changes to the App and to These Terms

We may add, change, or remove features, and we may stop offering the app. We may also update these Terms. The current version is always on this page with its effective date, and using the app after a change means you accept the new version. If a change is significant, we will point it out in the app.

14. Suspension and Termination

We can suspend or end your access to the tracking service if you break these Terms, in particular the acceptable use rules. You can stop using the app at any time, delete your tracked emails in the app, and cancel your subscription through Apple. Sections that should survive the end of these Terms, such as the disclaimer and the limitation of liability, remain in effect.
